Greece Divorce Filing Process

Greece residents file for divorce at the Monroe County Supreme Court. The court is at the Hall of Justice, 99 Exchange Boulevard, 5th Floor, Rochester, NY 14614. Phone: (585) 371-3758. The Supreme Court is the only court in New York that can end a marriage. Family Court handles custody and support, but not divorce.

The filing fee for the index number is $210. The Note of Issue is $125 and the Request for Judicial Intervention is $95. An uncontested divorce costs at least $335 in court fees. If you cannot afford the fees, the court offers a process to apply for a waiver. You need to submit an affidavit showing your finances.

Residency rules require at least one spouse to have lived in New York for two years straight. Or, if certain conditions are met, one year is enough. The most common ground for divorce is irretrievable breakdown under DRL Section 170(7). That is the no-fault option. It requires the relationship to have been broken for at least six months.

Note: Greece Town Court does not handle divorce cases; only the Monroe County Supreme Court has that authority.

State Divorce Certificates for Greece

The New York State Department of Health issues divorce certificates for all cases from 1963 to the present. The certificate shows basic info: names of both spouses and the date and location of the divorce. It does not include any of the settlement terms or other case details.

Mail requests cost $30 per copy. Send to: Vital Records Certification Unit, P.O. Box 2602, Albany, NY 12220-2602. Include a copy of your photo ID and a check payable to "NYS Department of Health." Wait time is 10 to 12 weeks. Priority handling is $15 extra and takes about two weeks. Online and phone orders are $45 plus a vendor fee. Only the named parties or someone with a court order can request this certificate.

For cases before 1963, the Monroe County Clerk is your only option. The state does not hold those older records.
