Certified copies generally cost $5.00 for up to four pages, with $1.25 for each extra page. The search fee is $5.00 per name for each two-year period.

Because Hamilton County is small and remote, it is a good idea to call ahead before making the trip. Confirm office hours and make sure the staff can pull the records you need when you arrive. New York law requires at least one spouse to meet a residency condition. The simplest is two continuous years as a New York resident. Other options allow one year of residency if you married in the state, lived here as spouses, or the grounds for divorce happened in New York. The NYS Courts divorce page has the full list of options and downloadable forms for both contested and uncontested cases.

After filing, the other spouse must be served within 120 days. Service requires someone at least 18 years old who is not a party to the case. If the other spouse signs an Affidavit of Defendant, you can file the Note of Issue right away. Otherwise, you wait 40 days after service. The Note of Issue costs $125. Total minimum fees for an uncontested divorce come to about $335.
