Oswego County Clerk Divorce Records

The Oswego County Clerk's Office is located at 46 East Bridge Street, Oswego, NY 13126. You can call them at 315-349-8230. The office keeps all Supreme Court records for the county, which includes divorce decrees and judgments of divorce. As clerk of the court, the office files and stores every matrimonial case that gets decided in Oswego County.

Access to divorce records is limited by state law. Under Domestic Relations Law Section 235, matrimonial files stay sealed for 100 years after the date of the final decree. Only the parties to the divorce, their attorneys of record, or someone with a notarized authorization letter can get copies. You must bring a valid photo ID. If you show up without it, the clerk will not release anything.

Certified copies of divorce decrees cost about $5 for up to four pages. Extra pages are $1.25 each. If you need the clerk to search for a case and you lack the index number, they charge $5 for every two-year period they need to look through. Mail requests are accepted too. Include a self-addressed stamped envelope along with your written request and payment by money order or certified check.

Oswego County does not run its own online portal for divorce record searches. But the state provides tools that cover every county. WebCivil Supreme is a free search system run by the New York Unified Court System. You can look up cases by party name, index number, or attorney name. The results show case status, party names, and filing dates. It will not show the full divorce decree, but it gives you the index number you need to request a copy from the clerk.

The NYSCEF system handles electronic filing for Supreme Court cases, including divorces. If a case in Oswego County was filed through NYSCEF, you can track its status online. Oswego County Supreme Court

The Oswego County Supreme Court is the only court that can grant a divorce in the county. It is part of the 5th Judicial District, which also includes Jefferson, Lewis, Oneida, and Onondaga counties. All divorce petitions in Oswego County go through this court. The Family Court can handle custody and child support matters, but it does not have the power to end a marriage.

Filing a divorce in Oswego County starts with buying an index number for $210. The note of issue fee is $125. Motions cost $45 each. How to Get Oswego County Divorce Records

There are two types of divorce records in New York. The divorce decree is the full court document with all the terms of the divorce. It is filed with the Oswego County Clerk. The divorce certificate is a shorter record kept by the NYS Department of Health for divorces from January 1, 1963 onward. The certificate shows the names and the date the divorce was granted. It costs $30 by mail or $45 if ordered online.

Residency and Filing Rules

To file for divorce in Oswego County, you must meet one of five residency requirements. The simplest is that either spouse has lived in New York for at least two continuous years before the filing date. Other options include being married in New York with one year of residency, or having lived together in the state with one year of residency. The grounds for divorce can be no-fault (irretrievable breakdown for six months) or fault-based.

After filing, the plaintiff has 120 days to serve the defendant with the divorce papers. If service does not happen within that window, the case could be dismissed. Service must be done by someone who is at least 18 years old and is not the plaintiff. Once served, the defendant has a set number of days to respond. In an uncontested case where the defendant does not answer, the plaintiff waits 40 days and then files the note of issue to move the case toward judgment.
