Rensselaer County Clerk Divorce Files

The Rensselaer County Clerk's Office is at 105 3rd Street, Troy, NY 12180. Call 518-270-4080 for questions. The clerk is the official keeper of all Supreme Court records in the county. This includes divorce decrees, judgments of divorce, separation agreements, and the complete case files for every matrimonial action decided here.

State law restricts who can see divorce records. DRL Section 235 seals all matrimonial files for 100 years from the date of the final court decree. The only people who can get copies are the parties to the divorce, their attorney of record, or someone who has a notarized letter from one of the parties. You also need valid photo identification. The clerk's office checks these requirements carefully before releasing any records.

A certified copy costs about $5 for up to four pages, with each extra page at $1.25. A search fee of $5 per two-year period applies when the clerk needs to look for a case. Plain copies are available at around $0.65 per page. Mail requests should include a self-addressed stamped envelope and payment by money order or certified check.

Rensselaer County does not have a local online search system for divorce records. The WebCivil Supreme database covers all 62 counties and lets you search by party name, index number, or attorney. It is free. You can see the case type, status, and key dates. The full decree text is not available online because of the confidentiality rules, but the index number is useful for making a request to the clerk.

Rensselaer County Divorce Court System

The Rensselaer County Supreme Court is part of the 3rd Judicial District. This district also covers Albany, Columbia, Greene, Schoharie, Sullivan, and Ulster counties. The Supreme Court is the only court in New York that can grant a divorce. Family Court handles custody, visitation, and child support, but it cannot end a marriage.

Filing a divorce in Rensselaer County costs $210 for the index number. The note of issue is $125. Motion fees are $45 each. If you cannot afford these, you can apply to proceed as a poor person by filing the appropriate affidavit with proof of income. The court reviews the application and makes a decision.

After the plaintiff files the divorce papers, they have 120 days to serve the defendant. A person over 18 who is not the plaintiff must handle the service. The defendant then has time to respond. In uncontested cases where the defendant does not respond, the plaintiff waits 40 days and then files the note of issue. The judge reviews the papers and, if everything is in order, signs the judgment of divorce. The clerk files it, and the date on the stamp is when the divorce is final.

Getting Rensselaer County Divorce Records

Two types of divorce records exist in New York. The decree is the full court order kept by the Rensselaer County Clerk. It has all the terms and conditions of the divorce. The certificate is a shorter document held by the NYS Department of Health for divorces from January 1, 1963 forward. The certificate costs $30 by mail or $45 online. Either spouse can request it.

Before 1963, only the decree at the County Clerk's office exists. No state-level certificate was issued for those older cases. For records from before 1847, the New York State Archives is the place to check. The archives hold historical court records from across the state.
